Rule of Law KOS Requisition # Total Views Background: The Governance Sections (GS) project Promoting Quality in Public Processes III under the Activity Promoting access to public documents and privacy protection, continuous to support the Information and Privacy Agency (IPA) in promoting and enhancing the implementation of the laws on Protection of Personal Data and Access to Public Documents. The protection of personal data, according to the IPAs assessment, is an area where further work is needed in terms of promotion and guidance for the specific profile groups. In this regard, the media that processes personal data in their reporting, is frequently found in breach to resident right to privacy during their reporting work. To address this, the head of the IPA, requested Missions support in provision of a short-term privacy protection expert, in drafting the tailor-made guidelines for the needs of media outlets. In addition, the expert will develop guidelines on data subject rights, which will inform the data subjects on their privacy rights such as for example: the right of rectification, the right to erasure (the right to be forgotten) and other specific rights, foreseen by the Law No, 06/L- on Protection of Personal Data.The request for this support has been submitted to the Mission in , and the Mission included it in the 1st Amendment of the GS UB Project . The IPA is an independent agency for supervision of implementation of the law on access to public documents and protection of personal data. Assistance to the IPA is part of Missions overall support in enhancing the efficient oversight role of the independent institution over the governments compliance with laws.The expert will work closely with the activity manager and the IPA. Objective of Assignment: Support the IPA in improving the implementation and promotion of the law on protection of personal data through specific tailor-made guidelines and ultimately ensuring better protection of residents right to privacy. Duration of Assignment: The Consultant will be hired for 20 working days. Tasks and Responsibilities: Develop a comprehensive guideline aimed at ensuring compliance of data processing by the Media with the Law No. 06/L on Personal Data Protection.Develop Guidelines for Data Subject Rights.Draft the final report on the work conducted under the present ToR. Deliverables: By the end of June, the guideline aimed at ensuring compliance of data processing by the media drafted and accepted by the IPA;Performance indicator: timely submission of the draft guidelines to Activity Manager.By the end of July, guideline for Data Subject Rights drafted and accepted by the IPA;Performance indicator: timely submission of the draft guidelines to Activity Manager.By the end of August, submit the final report, including gender-disaggregated data, where applicable, of all the work performed during the present consultancy.Performance Indicator: Timely submission of the final report, including gender disaggregated data if applicable, to the Activity Manager. Necessary Qualifications: University degree in law, or a related discipline;At least five years of relevant professional experience, preferably in drafting guidelines and sub-legal acts;Specific knowledge of the domestic legal framework on personal data protection;Knowledge of the General Data Privacy Regulation (GDPR) is an asset;Excellent organizational skills with capacity to deal effectively with changing priorities;Command of Windows software, Microsoft Office and Microsoft Outlook;Ability to keep strict deadlines and deal with several activities simultaneously;Fluent in Albanian and English, knowledge of Serbian is an asset.
